Terms of Service

1. Acceptance of Terms

By accessing or using the Phenolytics Academy platform (the “Service”), you agree to be bound by these Terms of Service and the operating rules that form part of the program. If you do not agree, do not use the Service.

Phenolytics Academy is an agency-building development program, not merely an online course website. Its purpose is to take a small cohort of participants from foundational technical knowledge through practical consulting, commercial capability, client acquisition and agency operations, culminating in readiness to operate an independent agency.

2. Description of Service

The Service sequences learning and development across the following areas:

  • Technical Capability (data, Power BI, data engineering, AI/ML, cloud, governance)
  • CRM & Lead Generation & Sales
  • Consulting Practice (discovery, requirements, solution design, delivery)
  • Agency Operations (setup, operations, finance, scaling)
  • Professional Practice (communication, writing, meetings, negotiation, remote client management)
  • Integrated Practicum and Agency Readiness

External platforms (including Microsoft Learn, Salesforce Trailhead and HubSpot Academy) provide learning depth and assessments. Phenolytics Academy owns sequencing, accountability, evidence collection, practical assignments, mentor review, progression rules, cohort management and agency-readiness evaluation.

3. Eligibility & Selection

Admission is by application and selection. The first cohort is a controlled pilot of a small group of participants.

  • Participants must complete the onboarding assessment accurately and honestly.
  • Selection decisions, including whether an application is accepted, remain pending until reviewed by the program team.
  • Certain areas of the Service are restricted to verified participants of the current cohort. Access to these areas is not guaranteed to all users.

4. User Accounts & Responsibilities

You are responsible for safeguarding your account credentials and for all activity conducted through your account. You agree to provide accurate information during onboarding and thereafter.

Your account represents your participant profile. Progression and outcomes are personal to you and may not be transferred or shared with others.

5. Program Progression, Evidence & Attendance

Progress is evidence-based rather than based only on self-reported completion. A module should not be considered complete merely because a completion button is clicked.

  • Required evidence and practical work must be approved before completion is awarded.
  • Failed work returns to “Revision Required” rather than simply lowering a total score.
  • Attendance at scheduled meetings is tracked separately from academic performance.
  • Repeated absence or non-participation may result in penalties, which are transparent and auditable.

Points, badges and leaderboard positions (NovaPoints) are provided for motivation and accountability and do not constitute a guarantee of any outcome.

6. Readiness Assessment

A final agency-readiness assessment evaluates technical, consulting, commercial and operational capability before graduation.

The suggested readiness score weights dimensions such as Technical Capability, Practical Delivery, Consulting & Client Skills, Business Development and Professional Discipline. Weights may be adjusted by administrators. A readiness score is an evaluation, not an entitlement.

7. Intellectual Property

All content, curriculum sequencing, materials, tools and original work developed by Phenolytics Academy for the Service are the property of Phenolytics Academy and its licensors.

Participants retain ownership of the work and projects they submit as evidence. By submitting work, you grant Phenolytics Academy a limited license to use it for the purpose of evaluating, delivering and improving the program.

8. Termination & Discontinuation

Phenolytics Academy may suspend or terminate access to the Service where a participant breaches these Terms, engages in prohibited or disruptive conduct, or for operational reasons.

The program is offered in a pilot phase and may be modified, paused or discontinued at any time. Administrative decisions regarding scores, penalties, attendance corrections and module approvals may be recorded and audited.

9. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. Participation does not guarantee employment, clients, revenue, graduation or independent agency success.

To the maximum extent permitted by law, Phenolytics Academy shall not be liable for any indirect, incidental, special or consequential damages arising from use of the Service or participation in the program. Any external platforms and resources are provided for reference; their terms govern your use of them.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service or applicable requirements. Updated Terms will be published on this page and take effect on the date shown. Continued use of the Service after an update constitutes acceptance of the revised Terms.
